This is a non-binding English translation for your convenience. The German version is legally binding.
These General Terms and Conditions ("T&Cs") apply to all contracts between Ebenhoch Studio, owner Tamara Ebenhoch ("Ebenhoch Studio"), and its clients regarding services in the field of interior design and consulting. Deviating terms of the client will only be recognized if Ebenhoch Studio has expressly agreed to them in writing.
The Ebenhoch Studio website serves to present services, references, and contact options. The specific scope of services (e.g. scope of moodboard, color and material concept, 2D/3D visualization, shopping list, revision rounds, project management) results from the individual, written offer.
Submitting an inquiry via the website, email, phone, or WhatsApp does not yet constitute a contract. A contract is only concluded upon the client's written confirmation of the individual offer and receipt of the agreed deposit.
Binding prices result exclusively from the individual, written offer. Unless otherwise agreed in the offer, the following applies:
No VAT is charged according to § 19 UStG (German small business regulation).
Services that go beyond the scope agreed in the offer (e.g. additional revision rounds, further visualizations, express processing, site visits, or shopping assistance) will be billed separately according to the terms valid at the time of commissioning.
For smooth cooperation, the client shall promptly provide all necessary information, plans, measurements, access to the premises, and decisions. Delays caused by lack of cooperation will extend agreed project deadlines accordingly.
All moodboards, concepts, visualizations, texts, and graphics created within a project are subject to Ebenhoch Studio's copyright. Upon full payment, the client receives a simple right of use to the documents created individually for them, for their own private or business use. Any further distribution, publication, or reproduction requires the written consent of Ebenhoch Studio.
Ebenhoch Studio is entitled to use photos and visualizations of completed projects for its own portfolio, website, and social media channels, unless the client expressly objects in writing. Upon request, the presentation will be anonymized, without naming names or exact addresses.
The following additionally applies to all plans, technical drawings, visualizations, and other documents created within a project:
Ebenhoch Studio's services are creative consulting services; aesthetic and subjective assessments may vary. For furniture, materials, or products from third-party providers or craft services, only the warranty terms of the respective provider or trade apply.
Ebenhoch Studio is liable only within the scope of statutory provisions. In cases of slight negligence, liability exists only for breach of material contractual obligations (cardinal obligations), limited to foreseeable damage typical for this type of contract. Liability for indirect damages or loss of profit is excluded. Liability for intent, gross negligence, and injury to life, body, or health remains unaffected.
If the client cancels an order already confirmed in writing, services already rendered as well as costs incurred up to that point may be invoiced. The deposit already paid will be offset in this case.
